General
We consider privacy to be extremely important. We want to inform our customers and users of our services and websites as much as possible, respect them and give them control over what happens to their data.
Below you will find information about what data we collect, why, for how long and how you can control it.

1. Who is protected by this privacy policy?
This privacy policy applies to all natural persons, such as tenants, owners, their agents, ... This privacy policy is not intended for legal persons.

Until 24/05/2018, the law of 08/12/1992 on the protection of privacy with regard to the processing of personal data and its implementing decrees constitute the applicable privacy legislation. As of 25/05/2018, it will be replaced by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation). As this privacy statement is already based on the new legislation, some of the procedures described in this privacy statement will only be operational after that date.
2. What is meant by "personal data", "data processing" and who is the "data controller" and the "DPO"?
Personal data is any information relating to an identified or identifiable natural person. It can be, for example, a person's name, a photograph, a telephone number, a code, a password, a contract number, an e-mail address.
Processing is any operation involving personal data. By "data processing" we mean any processing of personal data. The term "processing" covers, among other things, the collection, recording, organization, storage, updating, modification, retrieval, consultation, use, dissemination or otherwise making available, compilation, combination, archiving, erasure or destruction of personal data.
We are the controller of your personal data. This means that we determine the purpose and means of processing your personal data. We are your contact person for all questions regarding the use of your data.
If we allow our customers' end users (such as employees, trainees, ...) to use our products and services that fall under the scope of this privacy policy, we have the following responsibilities:
We must adequately inform end users that, through their use of our products and services, we will be processing their personal data We must obtain all legally required consents from end users before processing their personal data
We must not use our products and services to collect personal data in violation of applicable privacy laws.
We must inform you of the level of security of our products and services and take appropriate technical and organizational measures, at our discretion and within our capabilities, to adequately protect personal data against unauthorized or unlawful processing and against unlawful or accidental destruction, accidental loss, alteration, unauthorized disclosure or unauthorized access. We shall take all reasonable steps to ensure the trustworthiness of end users who have access to personal data. We shall not do, cause or permit anything that would in any way result in a breach of these privacy laws. Through our products and services, you may also use the services of other parties such as chat, third party websites, forums, Facebook, Twitter, newsgroups and/or applications. We have no control over, and are not responsible for, the information you post there or how it is handled. It is your responsibility to use it wisely and to read the privacy policies of these third parties carefully.
We are the data controller of your personal data, which means that we are your point of contact and the point of contact for the supervisory authorities for all questions regarding the use of your data.
3. What data do we process?
During the various contacts with you, we are likely to collect various personal data: identification data (surname, first name, address, ...), contact data (address, e-mail address, telephone, ...), data relating to the rented/sold and rented/purchased property, data relating to the rental contract, data relating to the sales contract, ....
We will process your data:
- When you become a customer
- When you fill in the forms, documents and contracts we submit to you
- When you use our services and products
- When you contact us through the various channels available to you
- When your data is published or communicated by authorized third parties (persons you have specially authorized, the Belgian Official Gazette, your real estate agent, your steward, your trustee), etc.
- When you communicate data when using our websites: when you request a quote or place an order online, or when it is done for you, ...
- When you visit one of our websites or use our apps via cookies and other technologies, ...
- When we ask you for your personal data, you have the right to refuse. However, such refusal could prevent the start of a business relationship or the execution of its services, change its nature or affect its management.
4. What is the purpose of this data?
We process your personal data for various purposes, using only the data necessary to achieve the intended purpose.
We use your personal data :
- When we have received consent
- In connection with the preparation or execution of our services
- In order to comply with legal or regulatory requirements to which we are subject, such as the prevention of money laundering, the fight against tax fraud and tax obligations.
- Where we have a legitimate interest in doing so, in which case we will always endeavour to balance that interest with respect for your privacy.
5. How do we secure your data?
Access to your personal data is only allowed to those who need the data to perform their duties. They must respect strict confidentiality and comply with all technical and organizational requirements to guarantee the confidentiality of personal data.
Under no circumstances may such data be stored outside the European Union. Our websites sometimes provide links to third party sites (social media, event organizers we sponsor) whose terms of use are not covered by this privacy policy. Please read their privacy policies carefully.
6. Do we sell or transfer your data to third parties?
We do not sell or transfer personal data to third parties, except:
To our successors in title. We will transfer your personal data to our successors and associated companies (such as subsidiaries and affiliates), if any, for the same purposes as set out in this Privacy Policy.
This is necessary to provide our services. For some aspects of our products and services, we work with third parties or hire subcontractors. The transfer of your data will only take place for the same purposes as mentioned in this privacy policy. We ensure that, like us, they manage your data securely, respectfully and with due care.
There is a legal obligation.
There is a legitimate interest for us or for the third party concerned. This only occurs if your interest or your fundamental rights and freedoms are not overriding.
You give us permission to do so. If we transfer personal data to third parties in any other way, this will be done by explicit communication, in which an explanation is given about the third party, the purposes of the transfer and the processing. Where required by law, we will obtain your explicit consent. You also have the possibility to object at any time.
7. As a customer, how do you determine what personal data we may use and how?
We use your data to provide you with excellent service and general communication about the products and services you have with us or that may be of interest to you. At this level, the above mentioned data will be processed in the context of our legal obligations, our legitimate interest and the proper performance of your contract (including complaint and customer management, as well as information about and improvement of the services). You choose not to receive direct marketing, but we will of course continue to inform you about how to make the best use of the products and services you already have. For example, we may suggest a product or service better suited to your needs.
8. What are your rights and how can you exercise them?

- You have the right to access (free of charge) data about you.
You can ask us:
- Whether we are processing personal data about you
- What we are processing it for
- The origin of the data we are processing
- The logic we use when we process certain personal data automatically
- You must request your right of access by e-mail. In order to exercise your right of access and to prevent unauthorized disclosure of your personal data, you must provide us with proof of your identity. We therefore ask that you attach a copy of the front of your identity card to your request.
We have 45 days to respond to your request. Please note that this time limit does not begin to run until we have received your request and all the information necessary to respond to it.
If you have reason to believe that we have not processed your request properly, please contact us first by email so that we can review our options with you. For the sake of completeness, we inform you that if we do not respond to your request, refuse your request, or if our response does not meet your expectations, you always have the right to file a complaint with the Privacy Commission via commission@privacycommission.be, which will then intervene in its mediation mission.
Right of correction and deletion
You have the right to have incomplete, incorrect, inappropriate or outdated personal data deleted or modified. To do so, please contact our services. We will then correct or delete this information within the legal time limits, if necessary. Please note, however, that depending on your request, we may no longer be able to offer you certain services. It is also not always possible for us to delete all requested data.
Your right to object to the processing of your data for direct marketing purposes.
You always have the right, without giving a reason, to object to the use of your personal data for direct marketing purposes. You can always contact us to deactivate our possibility of promotions and/or actions by telephone, mail, SMS or e-mail.
9. How long do we keep your personal data?
We take appropriate organizational and technical measures to secure personal data. We are not allowed to keep personal data longer than necessary to fulfill the purpose for which we collect it. Once all purposes have been fulfilled, this data is deleted.
This means that the processed data is kept for the duration of our agreement, the legal retention period and any other retention period that may be imposed by applicable laws and regulations.
